Employment and Labour Law Shivamba has led amongst others, the following instructions/matters:
- Assisted clients with the processes of terminating an employment contract of a Managing Director;
- Drafting and reviewing of employment contracts;
- Opposing Applications for unfair dismissal, unfair suspension and unfair labour practice- employment benefits in the CCMA;
- Inspected the human resource process of the client, and reviewed and drafted employment policies, procedures and disciplinary codes to ensure that they are in line with current legislations regulating the employer-employee relationship. Constitutional and Administrative
- Assisted client with the interpretation of Treasury Regulation 16A6.6 on whether the specified public institution qualified to utilise the latter whilst it is not the listed public entity in terms of the Public Finance Management Act. Whether the conduct of the entity is compliant with the mandatory elements in terms of section 217 of the Constitution when it appointed the service provider.
- Assisted clients with drafting applications for access to information. Further assisted a client, who received an application for access to information, with drafting a response to an Applicant.
- Assisted client with the drafting of Review Application in terms of Promotion of Administrative Justice Act. Litigation
- Urgent Application and Review Application regarding the lawfulness of the termination of a Service Level Agreement, the interpretation of section 217 of Constitution and PFMA and Treasury Regulations in the Pietermaritzburg High Court.
